(AP) The curare-murder trial of Dr. Mario Jascalevich went to the jury Monday after 34 weeks of testimony about the mysterious deaths of three hospital patients more than a decade ago. The jury deliberated for 45 minutes, then retired for the evening, after the judge reviewed evidence and instructed the six men and six women on the law for 1 hours. The ease evolved into a free press-fair trial battle that resulted in the jailing of New York Times reporter Myron Farber. Jascalevich, 50, was indicted in May 1976 on charges that he used the muscle relaxant curare to murder five patients at Oradell's Riverdell Hospital in 1965 and 1966.

At the conclusion of the prosecution's case, Acting Superior Court Judge William Arnold dismissed two murder counts, citing lack of evidence. If convicted on the remaining counts, Jascalevich faces a maximum Gunman, 'torch' keep Notre Dame worried SOUTH BEND, Ind. (AP) Two campus policemen at the University of Notre Dame were fired upon by an unknown gunman Monday as they headed toward the fifth in a recent series of fires at the university, school officials said. Two shots struck their car, shattering the windshield and puncturing a door on the passenger side, but the two men were unharmed, said university spokesman Richard Conklin. Sgt.

RARABOO Mr. William Benzies Jr. age 71, of Baroboo. passed away on Saturday evening, October 21, 1978, at a Reedsburg nursing home after a long illness. Mr.

Benzies was born on July 12, lvoi, in Chicago, and had been a Baraboo resident since 1929. He was a retired owner and operator of the Benzies Fuel Company. Mr. Benzies was a member of the Baraboo Mansonic Lodge Consistory; the Zor Shrine; a life member ot the Baraboo Elks Club; past president of the Baraboo Country Club; past president of the Devils Lake Concessions; past president of the Baraboo School board; and the state board of Vocational, Technical and Ad'ilt Education from 1965 1971. He was also a graduate of the University of Illinois; a member of the Alpha Chi Rho fraternity; and a member of the Campus Commission.

Survivors include his wife, the former Margaret Marling; three daughters. Miss Sandra Benzies of Chicago, Mrs. Robert (Sally) Bock of Madison, Mrs. Louis (Betty) Merrifield of Cedar Rapids, Iowa; and three grandchildren. Funeral services will be held at 2 p.m.

on Tuesday, al the HANSON FUNERAL HOME. Reverend David Gilmore of the First Presbyterian Church will officiate. There will be no visitation, the familv suggests memorials may be mode to the U.W. Baraboo Memorial Scholarship Fund. Burial will be in Wolnut Hill Cemetery.

Bergstrom, Marilyn (Mrs. Raymond MADISON Marilyn (Mrs. Raymond Bergstrom, age 73, of 503 North Seventh Street, passed away on Monday, October 23, 1978 at a Madison hospital. She was born on August 8, 1905, to John and Ingborg Olstad in the town of Cottage Grove. She had worked for many years at the State Motor Vehicle Department and was also employed by the U.S.

Post Oftice. She was married to Raymond Bergstrom in 1924. They farmed in Cambridge for many years before moving to Madison. She was a 1923 graduate of Deerfield High School. She was baptized and confirmed at The St.

Paul Liberty Church in Deerfield and was a member of the East Koshkonong Lutheran Church. Survivors include her husband; two sisters, Mrs. Ella Grodske of Deerfield, Mrs. Albert E. Johnson of Edgerton; nieces and nephews.

She was preceded in death by a daughter, Vernoldine Levine and a granddaughter, Susan. Funeral services will be held at THE GUNDERSON FUNERAL HOME, 5203 Monona at 1:30 p.m. on Wednesday, October 25. Reverend Gerald Check will officiate. Burial will be in East Koshkonong Cemetery.

Friends may call from 4 to 8 p.m. on Tuesday, October 24, at the Funeral home. Memorials may be made to The East Koshkonong Lutheran Church or the American Cancer Society. Buttery, Mrs. Homer H.

DARLINGTON Mrs. Homer H. Buttery, age 79, was found in her home on Saturday, October 21, 1978. She had passed away from natural causes. She was born in Darlington on May 18, 1899.

She was the former Frances G. Grange, daughter of Albert and Anna Jones Grange. She married on January 1, 1927 in Darlington to Homer H. Buttery. She was a bookkeeper for 40 years at the Lane Lumber Company, Darlington.

Survivors include a son, William A. Buttery of Oracle, Arizona; a daughter, Mrs. John (Mary) Carter of New Port Richey, Florida; two brothers, Howard Grange of Darlington, and Raymond Grange of Roseburg, Oregon; and four granchildren. She was preceded in death by her husband in 1970 and a brother Paul. She was a member of the Wimodaughsis Chapter 93 Order of the Eastern Star of Darlington.

Funeral services will be held on Tuesday, October 24 at 2:00 p.m. from the ERICKSON-SHARER FUNERAL HOME. Paster Harley L. Curtis will officiate. Burial is in the Union Grove Cemetery.

Friends may call at the funeral home on Tuesday, from noon, until time of services. A memorial fund for The Heart Association has been established. Cockrell, Loran B. MADISON Loran B. Cockrell, age 86, of 110 South Henry Street died Sunday, October 22, 1978 at a Madison hospital.

He was born in Harper County, Kansas, grew up in Texas, and was graduated Northwestern University. Employed by the YMCA for thirty-six vears, he was its Executive Director for the last ten years. He was a veterean of World War I and had been a fighter pilot in the LaFayette Escadrille. He was an elder and a long time member of Christ Presbyterian Church and a member of the Madison Downtown Kiwanas Club. Surviving are his wife, Elsie; two daughters, Mrs.

Gilbert (Jane) Tybring and Mrs. Robert (JoAnn) Lampan, both of Madison; a son, James of Ann Arbor, Michigan; a brother, Frank of Spokane, Washington; sixteen grandchildren; and fourteen greatgrandchildren. Memorial services will be held at CHRIST PRESBYTERIAN CHURCH at 944 East Gorham Street on Wednesday afternoon, October 25. Officiating will be the Rev. Stewart Coffman, the Rev.

Garfoot, age 78, of Cross Plains died on Sunday, October 22, 1978 at a Mt. Horeb Nursing Home. He was born on October 1, 1900 in the town of Cross Plains and had farmed there for many years, prior to moving to Cross Ploins in 1955. He had also worked as a Mechanic for Kalscheur Implement Company in Cross Plains and for the Farmer's Mercantile Co-op In Black Earth, His wife, the former Genevieve L. Power, whom he married on September 26, 1923, died on August 23, 1977.

He was a member of St. Francis Xovier Catholic Church, Cross Plains and of Its Holy Name Society. He is survived by three sons. Earl Mt. Horeb, John and Eugene, both of Cross Plains; a daughter, Mrs.

Thomas (Noreen) Esser, Cross Ploins; 12 grandchildren; two sisters, Mrs. Gladys Murphy and Mrs Edward (Mildred) Faust, both of Cross Plains; four brothers, Ronald, Gerald and Floyd oil of Decauter, Illinois and Lester of California. The hospital deaths were investigated in 1966 by then-Bergen County Prosecutor Guy Calissi, but no charges were filed at that time.

Jascalevich's defense attorney, Raymond -A. Brown, charged during the trial that then-Prosecutor Joseph C. Woodcock Farber and New York City Medical Examiner Michael C. Baden conspired to bring about the surgeon's indictment. The prosecution maintained that Jascalevich administered the fatal dosages of curare because his position at the hospital was being undermined by the addition of new surgeons.

The dead patients all were being treated by other doctors. Al the request of the defense, Arnold ordered Farber and the Times to turn over their files on the case. Both refused and on July 24 were found in civil and criminal contempt. Farber spent seven hours in jail July 24 before winning a stay. He returned to jail for 27 days on Aug.

4, and again returned on Oct. 12. The Times, also convicted of civil and criminal contempt, has paid $265,000 in fines, including a $100,000 criminal penalty and $5,000 a day in civil fines. Times attorney Eugene R. Scheiman said Monday.

The Times says it turned over everything in its files on the Jascalevich case, but Superior Court Judge Theodore W. Trautwein accused the newspaper of "sanitizing" its file. She is survived by her husband, Richard; a son, Michael, St. Francis, Milwaukee, Wisconsin; a daughter, Mrs. Robert (Michele) Corrigan, Middleton; and three grandchildren. Mrs. Walter (Eleanor) Wipperfurth age 57, of 503 W. Main died Monday, October 23, 1978 at St. Mary's Hospital Medical Center. She was born Feburary 28, 1921 in Madison.

Mrs. Wipperfurth was a graduate of Central High School and a Veteran of World War II. She had previously been employed at the Schwoegler Bowling Alley; she was a member of St. Rachael's Cathedral arid a past President of the Altar Society. Mrs.

Wipperfurth was secretary of the New Voice Club; and a member of the Board of Directors of the American Cancer Society of Madison. She is survived by her husband, Walter; a son, James, US Armed Forces of Madison; four daughters, Mrs. John (Barbara) Marshall and Ms. Nancee Wipperfurth both of Steamboat, Springs, Ms. Linda Becker and Sherri Wipperfurth of Madison; a brother, John A.

Wermuth of Oregon; and four grandchildren. She was preceded in death by her parents, John and Marie Wermuth and a sister, June Wermuth. Funeral services will be held at St. Rachael's Cathedral 222 W. Main St.

Holsclaw, age 57, died on Saturday, October 21, 1978 ot a Madison hospital. He was born in Birmingham, Alabama on September 19, 1921. He was a graduate of the United States Naval Academy and a Navy veteran of World War II. Mr. Holsclaw was employed in sales by the Nelson Filter Corporation.

Mr. Koppenhaver was born on August 13, 1911, in Boone, Iowa. He married the former Valera Zingler in December of 1940. Albert was a avid sportsman and conservationist. He loved all outdoor activities including gardening.

Mr. Koppenhaver was a Conservation Warden for the State of Wisconsin from 1936 until 1974, when he retired. He was the past captain of the Guns for the State; and National Held Trials; a member of the Bashford United Methodist ChurrH the Madison Masonic the Yahi Fisnermans Club; the East Side Business Mans Club; the Dane County Conservation League; the Madison Retrievers Club; the Wisconsin Amateur Field Trial Club; the American Kennel Club; the Retriever Field Trial Club; Ducks Unlimited; and the Ozankee Retriever Club. Survivors include his wife, Valera; four sons, Roger and his wife, Jedn of Madison, Robert and his wife, Ann of Monona, Kenneth and David both of Madison; two grandchildren, Kevin and Kristin both of Madison; a sister, Eva Hiles of Boone, Iowa; a brother-in-law Alver Carstensen of Brooklyn, Wl; and a sister-in-law, Esther Koppenhaver of Boone, Iowa.
